Terms of Service

1. Who we are

“MarketFitt,” “we,” “us,” and “our” refer to MarketFitt, a sole proprietorship based in Ajax, Ontario, Canada. By accessing or using marketfitt.com or any related service (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. What the Service does

MarketFitt is a two-sided marketplace that connects:

  • Customers who publish pain-point briefs describing problems they need solved; and
  • Founders who build products and want validated feedback from real users matching those pain points.

Customers may receive free samples or free access to a founder’s product in exchange for providing structured feedback. MarketFitt facilitates introductions, feedback collection, and reputation tracking; we are not a party to any transaction between a customer and a founder.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Plans and billing

The Service is offered in tiered plans:

  • Free — no charge; limited capacity.
  • Solo Premium — USD $12/month, billed monthly, includes a 14-day free trial for first-time subscribers.
  • Team Premium — USD $29/month, billed monthly, includes a 14-day free trial for first-time subscribers.

Billing is handled by Paddle.com Market Limited (“Paddle”), our merchant of record. Paddle’s terms also apply to your purchase. You may cancel a paid plan at any time from your billing settings; cancellation takes effect at the end of your current billing period. Refunds are governed by Section 5 below.

5. Refunds and cancellations

Free trial. Both premium plans start with a 14-day free trial for first-time subscribers. You are not charged during the trial. If you cancel before the trial ends, no payment is taken and the plan reverts to Free. Trials are limited to one per customer; upgrading again after a previous trial will charge you immediately at the regular monthly rate.

14-day first-charge refund. If you are charged for the first time on a paid plan and determine within 14 days of that charge that MarketFitt is not right for you, we will refund the full first-month payment on request. To claim this refund, email support@marketfitt.com from the address on your account within 14 days of the charge and reference your billing receipt.

Subsequent renewals. After the first month, subscriptions renew automatically each month at the published price. We do not provide refunds for partial months or for renewals that you forgot to cancel. To stop future charges, cancel from your billing settings before the next renewal date; you will keep access for the remainder of the period you have already paid for.

Exceptional circumstances. We may issue a refund outside of the 14-day window at our discretion in cases of duplicate charges or other clear billing errors, material unavailability of the Service for a sustained period within the billing month, or suspected unauthorized use of your payment method. Contact support@marketfitt.com and we will review your case.

How refunds are processed. Approved refunds are issued by Paddle to the original payment method. Most refunds appear within 5–10 business days, depending on your bank or card issuer.

Cancellation vs. refund. Cancelling your subscription stops future charges but does not, by itself, trigger a refund of any past payment. If you also want a refund of a recent charge, mention this in the same email.

Free tier. The Free tier does not involve a payment and therefore no refund is applicable. You can stop using the Free tier and close your account at any time.

This section does not limit any non-waivable statutory rights you may have under applicable consumer-protection law in your jurisdiction.

6. Acceptable use

You agree not to use the Service to:

  • Submit false, misleading, or duplicate pain-point briefs to obtain samples you do not intend to evaluate honestly;
  • Resell, redistribute, or commercially exploit samples or free access provided through the Service;
  • Harass, defame, or threaten other users;
  • Scrape, reverse-engineer, or otherwise extract data from the Service in bulk without our written permission;
  • Upload content that infringes intellectual property, violates privacy, or breaks applicable law; or
  • Interfere with the integrity or security of the Service.

We may suspend or terminate accounts that violate these rules, with or without notice.

7. User content

You retain ownership of the pain-point briefs, feedback, and other content you submit (“User Content”). By submitting User Content, you grant MarketFitt a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate the Service (including sharing pain-point briefs with matched founders and sharing feedback with the relevant founder).

You represent that you have the rights necessary to grant this license and that your User Content does not violate any law or third-party right.

8. Founder obligations

If you are a founder using the Service to distribute samples or free access, you are solely responsible for the products you provide, including their safety, legality, fitness for purpose, and compliance with applicable consumer-protection laws. MarketFitt does not inspect, endorse, or warrant any product.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that pain-point matches will result in any particular outcome, sale, or customer relationship.

10. Limitation of liability

To the maximum extent permitted by law, MarketFitt’s total liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you paid us in the twelve (12) months preceding the claim, or (b) CAD $100. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (e.g., User Content license, disclaimers, limitation of liability, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts located in Ontario, Canada will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
